Abstract

This study aims to: (1) analyze the factors that cause differences in the determination of the beginning of fajr prayer time; (2) analyze the relevance of the determination of fajr ṣādiq as the beginning of fajr prayer time with the basic principles of Islamic law. This research is qualitative descriptive research using library research methods with normative of sharia and philosophical approach. The results of the study found several things. First, the difference in setting the schedule of fajr prayer is due to differences in the determination of the criteria of the elevation of the sun under the horizon and differences in interpreting the meaning of the naṣ and terms related to the time of fajr prayer, such as fajr, galas, isfār, tabayyun and others. Second, the basic principle in determining the beginning of the time of fajr prayer based on the perspective of Sharia is that the fajr prayer is determined by the signs that are believed, so that the criteria for the appearance of fajr ṣādiq are set at the unquestioned elevation of the sun and with signs that are ḥissiyah (observable with five senses) in accordance with maqāṣid al-taysīr that can be understood and observed by every Muslim. This study contributes to the studies related to determining the start of prayer times. The results of this study provide recommendation in the form of determining the angle of fajr ṣādiq at the criterion between -18º and iḥtiyāṭ 2 minutes or -17.5º, as a precautionary measure, so that the polemic that occurs in the community regarding prayer time schedules is expected to be reduced or even resolved.

Abstract

This article intends to know the status of the Hand Arrest Operation (OTT) carried out by the Corruption Eradication Commission (KPK) according to the views of legal practitioners. With a normative approach, this study examines the problems legal practitioners face more deeply. There is a difference between Hand-Arrest and Arrested Operations. It means that Hand Arrest Operations (OTT) and Being Arrested (TT) are the same if the procedure follows the rules set, namely Article 18 of the Criminal Code. It is in line with the views of practitioners of law.

Abstract

The Covid-19 epidemic has influenced numerous facets of human existence. There are a large number of layoffs which has a negative economic impact on the family. According to data made accessible by the Banjarmasin Religious Court, the divorce rate increased from 13729 cases in 2020 to 1652 cases in 2021. This study intended to identify the contribution to the cause of divorce in Banjarmasin during the Covid-19 pandemic. The method employed was empirical legal research, and the approaches were legal sociology and legal psychology. The results revealed that the covid-19 pandemic has contributed to the rising divorce rate. Economic issues, domestic abuse, and the presence of a third party are the leading causes of divorce. In addition, this study indicated that husbands were victims of domestic violence.

Abstract

This study explores the impact of transformational leadership on employee performance. Qualitative descriptive analysis is used to identify problem patterns and relationships between concepts. Literature analysis supplements the research by examining relevant journals and articles. Findings demonstrate a significant positive influence of transformational leadership on employee performance, motivating employees to achieve organizational goals effectively and efficiently. Organizational commitment and job satisfaction serve as mediators between transformational leadership and performance. Transformational leadership enhances performance by fostering increased commitment and job satisfaction. Employees who exhibit attachment to the organization and job satisfaction tend to perform better. Overall, transformational leadership positively influences employee performance, with organizational commitment and job satisfaction acting as mediators in this relationship.

Abstract

The objective of this study is to determine the level of effectiveness of Fitrah-based parenting education in improving parents' knowledge of nurturing children’s fitrah- based on Qur'anic values. The study uses the quasi-experimental method and a pre and post-test design for a single group. In February of 2023, thirty parents of children who attended Nurul Islam Al Husna Community Learning Center participated in a study conducted in Cimahi City. The treatment consisted of Fitrah-based parenting education, which addressed the importance of fitrah-based parenting in the digital era, the impact of technology on children's development, as well as parenting strategies on how to nurture children’s fitrah. Wilcoxon signed rank test was selected as the method for statistical analysis. The result revealed that there are significant differences between before and after training on the parents’ knowledge of nurturing children’s fitrah.

Abstract

A phenomenon revealed that there is a conflict between the objectives of the maqashid syari'ah and the decision of the Pangkajene Religious Court judge No.0228/PDT.P/2020/PA.PKJ in the case of a marriage dispensation application. The purpose of maqashid syari'ah in the dispensation of marriage is to avoid adultery that enters the maintenance of religion (Hifz al-Din). The marriage dispensation was proposed by the parents as applicants because their children have often gone out together and even had intercourse as husband and wife but this was rejected by the judge. The problem above is the goal to explain legal considerations by the judge of the Pangkajene Religious Court in the application for marriage dispensation and maqasid al-syari'ah review of the decision of the judge in the application for marriage dispensation. This research used a library research method by citing the contents of the judge's determination files and books related to the problem under study and the data used is in the form of secondary data, namely in the form of decisions of the Religious Courts. The fact is that in this stipulation the judge rejected the application for marriage dispensation by not considering the immoral acts that had been committed by the prospective groom and prospective bride. Furthermore, the purpose of maintaining religion in this determination is not fulfilled where the judge uses the method of avoiding mafsadah taking precedence over bringing maslahah as if contrary to the stipulation in which the judge rejects the proposed marriage dispensation application.

Abstract

This study discusses the use of anthropomorphism in two episodes of Upin and Ipin entitled Aku Sebatang Pensel and Aku Sebuah Jam. Through observation and note-taking techniques, data were obtained to analyze how the two episodes humanize pencils and clocks. The results of the analysis show the presence of anthropomorphic elements in both episodes, including human characters, emotions, and human behavior given to pencils and clocks. The pencils in the episode Aku Sebatang Pensel behave like humans with the ability to speak, interact, and show emotions such as worry, anger, pride, sadness, and joy. Meanwhile, the clock characters in the episode Aku Sebuah Jam also show human behavior with the ability to speak, share experiences, show concern, and dance. Sad emotions are also displayed by the clock characters. The characteristics of pencil and clock characters include helpful, encouraging, caring, argumentative, passionate, optimistic, cheerful, curious, obedient, and expressive. This study uncovers the use of anthropomorphism in Upin and Ipin animations, shedding light on its contribution to children's imagination, understanding of complex issues, and story appeal. Through this technique, young audiences can connect with the characters and develop empathy. The findings are relevant for the development of children's films and learning media, as an effective strategy to convey moral values. The study also encourages animation and creative producers to produce creative and diverse content, in line with the demands of complex audiences.

Abstract

This study aims to analyze the effectiveness of penal mediation efforts in achieving restorative justice and to analyze penal mediation efforts in stopping the investigation and prosecution of criminal cases. The type of research used is normative legal research, relying on and using library data, namely secondary data in the field of law. The technique of obtaining legal materials is by means of library research by collecting legal materials by reading, quoting, recording and understanding various legal literature and laws. The results of the study show that 1) the function and role of the state through penal mediation will reduce the burden on the state in punishing and imprisoning criminals because amicable and compromise solutions can be reached for the creation of restorative justice. 2) Termination of Prosecution because there has been a settlement of cases outside the court as stipulated in PERJA No. 15 of 2020 Article 3 paragraph (2) is the scope of settlement of criminal cases by mediation as an effort to realize restorative justice which is pursued with material and formal requirements.

Abstract

This study aimed to analyze the factors that influence brand loyalty, and the role of brand trust as an intervening variable in E-Commerce users. Two hundred and fifty (250) respondents participated in the sample data collection. The results of this study found that brand trust and brand image did not affect brand trust. Brand positioning, customer satisfaction, and brand awareness had a significant effect on brand trust. And, brand trust had a significant effect on brand loyalty.

Abstract

Lombok Island is a small island that is part of the Province of West Nusa Tenggara. In history, Islam on Lombok continues to experience various changes in various aspects including in terms of Islamic boarding schools and religious organizations. It certainly has an impact on the development of religious education in Lombok, where religious education is dominated by a centralized system of Islamic boarding schools. The purpose of this study is to analyze the views of Islamic boarding schools on tolerance education in Lombok and examine the methods and practices of tolerance education for students in Islamic boarding schools in Lombok. This research is a qualitative descriptive study. It explained certain social phenomena. It concludes that the concept of religious tolerance implemented in Islamic boarding schools in Lombok is rahmatan lil 'alamin which in practice always refers to adhering to the principles of ahlusunnah wal jama'ah, such as tawashut (moderate), tawazun (balanced), i'tidal (straight), and tasamuh (tolerance). The methods and practices of instilling the values of religious tolerance in students at Islamic boarding schools are first, organizational education. Second, the study of the turats. Third, the role models of figures or kyai, and the values of tolerance education that are practiced at Islamic boarding schools on Lombok Island are mutual understanding and acceptance, mutual respect and appreciation, deliberation, and upholding equality.
